How long is the license valid for?
Licensing is based on a per project basis, as set out in the terms set out in our licensing, and is not based on time. That said the license is not in perpetuity and expires after 2 years. What this means in practice is that, you have to use your image within 2 yrs for your specific project. As an example a publisher might purchase an image, but it takes 12 months from layout to printing, then another 6 months before the book even hits the shelves. If the book is popular then the book may be reprinted using the original image license during the next six months. After which the license will have lapsed and a new license will have to be obtained. The licensing is not based on print run.
What is meant by single use?
When you purchase an image license, the license covers one application only. For example a magazine cover and a quarter page insert would be two uses and would therefore require two licenses.
What is meant by derivative work?
Essentially you use the images for something else. In practical terms this means you cannot sell our images as your own work. For example setting up a stock library or selling the images to another publisher as your own work. In such cases we would use all legal means to recover damages.
Can I still sell my Postcards/books/etc after my license expires?
Yes of course, our license is not based on quantity, so provided they were created during the period of the license, there is no problem. In reality our time limit of licensing is more to protect ourselves legally. Otherwise it is technically possible that someone could in 40 yrs time use the image, perhaps using it as a 'historic' image. Who knows. In reality this is not an issue for 99.9% of customers and we feel 2 years is ample time to make use of your image.
Can I make Prints?
Absolutely. Many people do. What you cannot do is make prints and sell them as your own work. For example you might make a range of prints to sell, but you cannot sell these as your own work. The original image always remains our property, so should be credited as such unless otherwise mentioned. This is effectively to stop people using our images to enhance their own reputation.
Can I modify the images for my Photoshop/etc project?
Definitely, within reason you are free to be as creative as you please within law. About the only restriction would be to use our images for illegal or defamatory purposes. Again pretty much commonsense.
Is it possible to use your images in my template library?
If your library is derived works, such as business cards or website templates then yes with some points to note. The restriction is that the images you use in this way must be derived. For example a website template is fine, but not a website. The difference here is that you would be using the images to make a nice looking template. As a specific example, using part of an image blended into the banner, but not using an image - in it's image context. Each of which would require a seperate license. If in doubt please ask.
Do I have to credit your images?
You should always try and credit the image where possible. Of course some situations make this difficult, but in general appropriate credit should always be given. For an office presentation it would be overkill, for a book it would be mandatory.
Can I use the images in my school assignment/project/thesis?
Absolutely.
Can I sell posters of the images?
Yes of course. The condition being that you don't sell them as your own work. A poster should like all publishing use proper crediting.See "Can I make Prints?" above.
